The Descendants of Thomas Dulany

 

 

THE NAME

 

 

 

In its form, Delaney is a Norman name, form De l'aunaie, meaning "from the alder grove.' and doubtless some of those bearing the name in Ireland are of Norman stock. However, in the majority of cases it was adopted as the anglicized form of the original Irish O'Dubhslaine the word dubh, meaning 'black,' and slan, meaning 'defiance' or possibly taken from Slaine, a topographical name which most likely refers to the River Slaney. The name evolved from O'Dubhshlaine to O'Dulany to finally Delany, although the name is found in old records with the various spellings of O'Delany, Delane, and Dillane.

 

In modern America the forms used are mostly Delany. Dulany, Delaney, and Dulaney. It is interesting to note that the name has changed from Delany to Dulany to Delaney to Dulaney all in the same generation. One child within the family carrys the surname of Dulany, while another another carrys the name Delany. Generally, there areseveral reasons for the change in name patterns. Officials who were writing the names into public records, such as census, land records, marriage and death records wrote them as they thought they should have been spelled. Which makes the job of tracing ones family roots very difficult and confusing.

 

The second reason for name changes comes from within the family unit itself. Events, whether internal or external in nature, play a large part in how family members interact with each other. Name changes where the easiest way in which to rebel or disassociate oneself from dis-agreeable situations. And it was certainly much easier to change a name then, than it is now. For example, Joseph, Daniel, and Thomas Delany changed their name to Dulany after their arrival in the colonies. It has been said that they disapproved of their father's marriage to Sarah, thus they changed their nameto show their disapproval. Descendants of Thomas Delany would change their name again after the Revolutionary War, hoping to disassociate themselves from their Loyalist cousins of Maryland. Many family members added the 'e' to the name or took the Irish spelling of the name, Delany/Delaney.

 

 

 

 

 

ORIGINS

 

"Traditionally, the Delany clan was said to have been descended from one of the ancient clans of septs which migrated to Ossory, in the County Laoightis, Ireland, with King Herman, one of the five sons of Melisius, from Spain 1000 years before the birth of Christ. He was king and monarch of all Ireland and resided in Ossory at a place called Rathbeagh, pronounced "Rawbay." Ancient Ossory is now County Kilkenny, southern Tipperary, and the Barony of Upper Ossory, in Queen's County." (Dulany-Furlong, pg.4)

 

The home of the O'Delany's was Tuath-Na-Toraidh, when translated means 'the people of the district of the towers.' Tuath-Na-Toraidh was also located in Ossory, in fact, within miles of Rathbeagh. "The O'Delanys were chiefs of the territory called Coilluachtarach, now known as Upperwoods, at the foot of the Slieve Bloom Mountains, near the source of the rivers Nore and Barrow in County Lexis." (Dulany-Furlong, pg. 5) Today the name is prominent in the four baronies of Queen's County (now Leix) and in the five baronies of County Kilkenny.

 

The O'Delany Clan was a social and political force in Queen's County and was of ancient origin, Irish records mention Felix o'Dulany, a Cistercian monk, who was Bishop of Ossory from 1173 to 1202. He built the Cathedral of St, Canice in Kilkenny and he was interred at Jerpoint Abbey. ( Source: William M.Hennessy, The Annals of Loch Ce,Kraus Reprint, Ltd., 1965, Vol. 1., pg. 223) The fact that Felix O'Dulany was the Bishop of Ossory presents evidence that the family was of high standing in the community, The hierachy of Ireland in those times was composed from the sons of the kings and chiefs of the area. And accordingly, "there was no other country in which purity of blood was so severely guarded as in Ireland, the kings and chiefs to the humblest in the clans being of the same blood and held in strict accountability for the preservation in all its purity." The bard O'herrian, who died in 1420, in his topographical poem enumerating the Munster clans, refers to the Chiefs of the O'Dulanys: (Dulany-Furlong, pg. 5)

Is O'Dubhlaine, the man of hospitality,

From the mountains of the most delightful.

 

 

Thomas Delany's own family seems to have had social and political prominence in Ireland. Daniel Delany, his brother, was born in Queen's County, Ireland and is recorded dying in the year 1750. It is said he married into the "Uniacke' family, who like the O'Dulany clan were of ancient origin and highly distinguished in both England and Ireland. His nephew, Dr. Patrick Delany, was an alumni of "Trinity College, Dublin, Chancellor of the Christ Church, prebendary od Saint Patrick's Cathedral (Protestant), Dean of Down. A man of much knowledge and an author, he was a close friend to Jonathan Swift. His wife wife, Mary (Granville) was the niece of the first Lord Landsdowne, and a special friend of Queen Charlotte, wife of George III." (Dulany-Furlong, pg. 5-6)

 

 

 

America

 

The sons of Thomas Dulany arrived in Port Tobacco, Maryland in April of 1703. Joseph, Daniel, and William were bound in articles of redemption to the captain of the ship that had transported they to the Colonies. It was the right of the captain to sale at his own discretion these articles and make them indentured servants to the buyer. However, it appears that they made satisfactory arrangements upon their arrival for there is no evidence that they were indentured to any resident or planter in the Maryland area. Evidently, Joseph obtained and served an apprenticeship in a local doctor's office, William taught school, and Daniel studiedlaw in the office of Col. George Plater of Saint Mary's County, Maryland.

 

Thomas Delany, Sarah his wife and his son, Thomas arrived in Maryland in 1709. According to an entry in the MarylandCalender of Wills, Thomas Delany, age 19 witnessed and signed a will of one of the crewman of the vessel Mary out of London, England in the year 1709. The will was later recorded and probated in Maryland that year. Settling in Port tobacco and later Joppa, Maryland, the county seat of Maryland. Thomas changed his name to Dulany, to conform with his three son's name who had arrived before him.

 

Thomas Delany/Dulany's descendants are now spread across America. Descendents of a richIrish heritage. Possibly the descendents of kings and certainly, the descendents of educated and enlightened men who helped to ensure the birth of a new nation.

 

 

 

 

 

 

 

 

 

 

 

 

First Generation

1. Thomas Delany1 Dulany,1 son of Unknown Delany and Unknown, was born Queens County, Ireland 1662. Thomas died 4 April 1738 Baltimore County, Maryland, at 75 years of age.

 

He married twice. He married Unknown before 1682. He married Sarah Unknown before 1723. (Additional notes for Sarah Unknown 2)

 

Thomas immigrated, 1709. Destination: Port Tobacco, Maryland. Thomas Delany, Sarah his wife and his son, Thomas arrived in Colonies after his sons Joseph, Daniel and William. According to an entry in the Maryland Calender of Wills, Thomas Delany, age 19, witnessed and signed a will of a crewman of the vessel Mary out of London, England in 1709.

 

He made a will Baltimore, Maryland, 5 March 1738.3 Recorded on 4April, 1739 Baltimore, Maryland, Thomas Dulany bequeathed:....."to my son William Dulany all the tract or parcel of land called Wright's Forest containing one hundred acres"....."to my two sons, Thomas Dulany and Dennis Dulany, all that or parcel of land called Richardson's Negglect containing fourhundred and three acres to be equally divided"....."to my son, Daniel Dulany, one Shilling Sterlingand no more out of my estate"......."to my daughter daughter, Elizabeth, one feather bed and furniture, two cows and calves, ten pounds currency, one pistole and a broken piece of gold to make her two rings. Also I give to my aforesaid daughter when she is married an orphan boy called John Blizard. Except his father comes and pays the charge I have been at"......"all the rest and remainer of mypersonal estate after my lawful debts are paid and my wife's third part satisfied, I give to be equally divided between my aforesaid two sons Thomas and Dennis"....lastly I appoint my well beloved wife Sarah Dulany whole and sole execrix." He sites his children as: (first wife) Joseph Dulany, William Dulany, Daniel Dulany and Thomas Dulany (second wife) Elizabeth Dulany, Dennis Dulany, and John Dulany.

 

According to many of the genealogies that I have come across many of them site Gideon de Lune as the father of Thomas. However, I am inclined to agree with Benjamin Lewis Dulaney,author of Something about the Dulaney (Dulany) Family and a Sketch of the Southern Cobb Family that Thomas Dulany is not his son. " Some branches of the family claim to be of French origin and have adopted the coat of arms of one Gideon de Lune, who according to a Dictionary of French Heraldry, was knighted in the year 1622. But the Dulaney name runs back through Irish history, practically uninterrupted to the year of our Lord 1202....the name Dulaney was prominent over four centuries before the period of Gideon de Lune. In the year 1622 the surname Dulaney with its variations in spelling, was probably as common or pentiful in Ireland, as the given name Patrick was." And given the fact that Thomas and several of his sons were born in the traditional homelands of the O'Dulaney clan,I feel that it is highly unlikely that they are the descendants of the Frenchmen Gideon de Lune.

SecondGeneration

2. Joseph2 Dulany MD (Thomas Delany1)6 was born in Kilkenny County, Ireland 25 March 1682. Joseph died 13 September 1769 in Fauquier County, Virginia, at 87 years of age. According to Steve Arey, Joseph dead in Hamilton Parish, Culpeper County, Virginia.

 

He married Mary Lewis in Spotsylvania County, Virginia, 1715. Mary was born in Richmond City, Virginia 19 November 1696. Mary 7 was the daughter of Zachary Lewis and Mary Walker. Mary died 19 January 1762 at 65 years of age. Zachary Lewis settled in Prince William County, Virginia in 1692. Zachary was born in 1650 in Becknockshire, Wales, he was a lawyer, planter and a member of the church of England. Mary's brother Zachary Lewis Jr. was a member of the House of Burgessesand a law professor. Among his students at William and Mary College were Thomas Jefferson, John Marshall and Henry Clay. One of his daughters, Anne Lewis, married George Wythe, one of the signer of the Declaration of Independence. 8

 

Joseph's occupation: Doctor of Medicine in Virginia.

 

Joseph immigrated, 1703. Destination: Port Tobacco, Maryland. According to Broderbund's, The World Family Tree, Vol 6, Ed. 1, Tree1375 Joseph emigrated to America aboard a merchant freighter, The voyage took more than two months to complete and upon his arrival, Joseph, was bound in articles of redemption to the captain of the ship that had brought him to the Colonies. He appeared to have made satisfactory arrangements upon their arrival for there is no evidence that he was indentured as a servant to any planter or resident in the Maryland area. He obtained and served an apprenticeship in a local doctor's office.

 

Joseph served in the military in Virginia, before 1720. Joseph applied for bounty land. He received a bounty for service land "on the Little Fork of the Rappahannock in Spottsylvania County". And was granted land in the "forks of the Rapidan River", Prince William County Virginia on 28 September 1728.

 

The records of births and deaths of Joseph and Mary are taken from the old family Bible inherited by their eldest son John. Now the property of adescendant of William, third and youngest son of John. 9

A Joseph Delanie of Hamilton Parish, Prince William County, Virginia, planter, conveyed by deed 97 acres of land in St. George Parish to Robert Bristco of Brunswick Parish, King George County, 29 June 1734. This land had been granted to him by patent on 28 September 1728. Mary, hiswife, acknowledged her dower in these 97 acres. Recorded 7 October 1740. Joseph Dulany and Mary, his wife, of Orange County, sold 400 acres of land in Marks Parish to John Triplet of Westmoreland County. The agreement included five shillings sterling and payment of "one peppercorn on the feast of St. Michael,the Archangel." Both Joseph and Mary signed the deed, Mary spelling her last name Delany. 16 viii. Daniel Dulany14 was born 1732. Daniel served in the military in Culpeper County, Virginia, 1756. Henning's Statutes, Vol. 7, page 23.

+ 17 ix. Daughter Dulany was born 1734.

+ 18 x. Daughter Dulany was born 1736.

3. William2 Dulany (of Wye) (Thomas Delany1)15 was born in Kilkenny County, Ireland about 1684. William died 11 April 1745 in Wye, Queen's County, Maryland, at 60 years of age.

 

He married Unknown.

 

William's occupation: Teacher. William immigrated, 1703. Destination: Port Tobacco, Maryland. Arriving in Port Tobacco, Maryland withhis two brothers, Joseph and Daniel, William also satisfied his indenture and taught school in PortTobacco and evidence shows that he did so for many years or at least til 1721.

 

He made a will in Annapolis, Queen Anne's County, Maryland, 09 March 1744. He bequeathed, "to my son William Dulany and his heirs forever all my home plantation called 'Stanford' containing two hundred acres of land and also thirty acres of land called 'Mount Hill', thereunto adjoining....I give to my two sons Michael Dulany and Daniel Dulany and their heirs forever my plantation called 'Eustico' standing and being on the eastern side of Tuckahoe Creek and containing two hundred acres of landto be divided in the manner following, viz, the line to run across the plantation, my son Michael Dulany to have one hundred acres next to the creek and my son Daniel Dulany the other one hundred acres, the plantation being equally divided.....I also will that my son Michael build a twenty foot house fifteen foot wide on his brother Daniel's part of the plantation before or by the time his said brother Daniel arrives at the age of twenty-one years.......I give and bequeath to my daughter Elizabeth Dulany and her heirs forever my other plantation standing on the eastern side of the Tuckahoe Creek and known by the name of 'New Nottingham'........I give to my son Thomas Dulany one Shilling."(Source: Hall of Records, Maryland, Wills, liber 24, folio 61-62)

 

William's will was probated in Annapolis, Queen Anne's County, Maryland, 11 April 1745. With the deathof his father he became heir to a large plantation in Queen Anne's County, Maryland called 'Wright's Forest'. There is evidence that he lived in Culpeper County, Virginia for short time, probably on an extended visit to his brother Joseph's home. He returned to Wye, Queen Anne's County, Maryland and died there.

 

WilliamDulany (of Wye) and Unknown had the following children:

 

19 i. Elizabeth3 Dulany16 Received the plantation called 'New Nottingham' from her father upon his death.

20 ii. Daniel Dulany17 was born about 1725. Daniel died 1748 at 23 years of age.18 He made a will in Annapolis, Maryland. Received from his father half of the plantation called 'Eustico'.

21 iii. Thomas Dulany19 was born in Maryland 1730. Thomas settled in King and Queen's County, Virginia, where in 1756 he served in the French and Indian War. Drafted into the Seventh Company of Virginia under Joshua Lewis the following entry was made: "Thomas Dulany, draft, forty yrs, size 5'5", laborer, complexion dark." ( Source: Virginia Colonial Abstracts, King and Queen County, Virginia. Vol 35 also Virginia Magazine of History and Biography, Vol 1. p. 389.) It is said that Thomas left Virginia and was never heard from again.

+ 22 iv. William Dulany was born 1732.

23 v. Michael Anthony Dulany20 was born 1734. Michael died 15 March 1781 at 46 years of age. Served as a lieutenant in the Revolutionary War, died of lockjaw caused from a wound in the knee received at the Battle of Guilford Courthouse in North Carolina.

He served in the military during war time 1776. Received from his father half of the plantation called 'Eustico' which he shared with his brother Daniel.

4. Daniel2 Dulany (The Elder) (Thomas Delany1)21 was born Queens County, Ireland 1686. Daniel died 05 December 1753 in Annapolis, Maryland, at 67 years of age. His body was interred 1751 in Annapolis, Maryland, St. Ann's Episcopal Churchyard.

 

Hemarried three times. He married Charity Courts in Maryland, 1710. Charity 22 was the daughter of John Courts (Col). He married Rebecca Smith in Maryland, 1720. Rebecca was born 1696. Rebecca 23 was the daughter of WalterSmith (Col.) and Rachael Hall. Rebecca died 1737 in Annapolis, Maryland, at 41 years of age. Her body was interred 1737 in Annapolis, Maryland, St. Ann's Episcopal Churchyard. The family crests of both the Smith's and the Dulany's are depicted on her tomb.

 

He married Henrietta Maria (Lloyd) Chew in Maryland, 1740. Henrietta 24 was the daughter of Philemon Lloyd. She married Samuel Chew (Hon) before 1740. First married to Samuel Chew, she brought to her second marriage six children: Samuel Chew Jr., Henrietta Maria Chew, Philemon Lloyd Chew, Bennett Chew, Margaret Chew, and Ann Mary Chew.

 

He was a student in Ireland. School: University of Dublin.25 Upon arrival in the Colonies, at Port Tobacco, Maryland in 1703, Daniel served an apprenticeship in the office of Colonel George Plater of Saint Mary's County, Maryland, who had been Attorney General of the Province. In his long and successful career, Daniel Dulany served in the Lower and Upper Houses of the Assembly, held the offices of alderman, councilman, and recorder for Annapolis. He was Attorney General of the Province, Judge of the Admiralty, Commissary General, Agent and Receiver General, and a member of the Governor's Council of the Province of Maryland. He served on the commission fixing the boundary line between Pennsylvania and Maryland and he endosed and promoted industries in the Maryland area. He help to lay out the town of Frederick and encouraged settlement in and around the town.

 

In March of 1732 the proprietor of the province of Maryland in order to attract settlers to the Northern and Western areas of Maryland, made a proclamation declaring special landprices and taxes for any that wished to settle in the area. Large tracts of land were quickly secured by a relatively few wealthier citizens of Maryland. Listed are Dulany's:

 

1. Daniel Dulany took a patent for 'Monocacy Manor' a tract of 8983 acres.

 

2. Patrick Dulany took a tractupon which a portion of Frederick City was built. (This may be Daniel Dulany's cousin, Dr Patrick Dulany or his son as sited in Benjamin Lewis Dulaney's Book) 26

The Maryland Rent Rolls of 1768 for Frederick County site Daniel Dulany (Honorable, Esq.). The 1771-1772 Rent Rolls mention Daniel Dulany aswell as his son Walter. " The Tax Rolls for 1733 for Prince George County, Maryland did not includelarge land owners such as the Carrolls, Diggs, Taskers, and Dulanys. Were they excused from paying taxes?" 28

 

In the book by Audrey C. Land The Dulany's of Maryland, Land characterizes Daniel Dulany as an outstanding land speculator and that in his later years he was said to have owed 15,000 to 20,000 arces of land in Western Maryland. After his death about 10,000 arces were divided among his heirs. The land given to his son Daniel, theYounger were confiscated after the Revolutionary War.

 

"The home of Daniel Dulany, including seven acres of land, was bought by the government in 1808. The house was then torn down in 1883, but the present structure was built on it's original site, from the same plan, making use of the samebricks reclaimed from the original house. This house is on the grounds of the Naval Academy at Annapolis, Maryland."

 

" The Dulany name still survives in the tract of land in Maryland, once Dulany Manor. The Manor, owned by Daniel Dulany, the Elder, embraced 20,000 acres, and the part inherited by the Hon. Walter Dulany included 5,000 arces in Baltimore County, still known as Dulany's Valley." 29

26 iii. Dennis Dulany33 Dennis died 1780. Dennis served in the military 1743. Served as the Clerk of Kent County, Maryland in 1754. Returning to Maryland upon completely his term of military service, he commanded for two years, The Snow, "Swift" lading tobacco for Hanbury's of London. He inherited 5,000 acres of land upon the death of his father. 34

Elizabeth 39 was the daughter of John Brice and Sarah Frisby. She married Walter Dulany (Maj). Record of birth found in St. Anne's Reguster, Annapolis, Maryland, Vol I, folio 136. 40

32 ix. RichardDulany was born 19 August 1745.41 Record of his birth found in St. Anne's Episcopla Church Register, Annapolis, Maryland, Vol I, folio 143. Richard died in infancy. 42

5. Thomas2 Dulany (Thomas Delany1)43 was born in Ireland 1689.

 

He married Anna Unknown.44 Thomas came to America in 1709 with his father and stepmother on the vessel Mary out of London, England. As recorded in the Maryland Calender of Wills, Cotton, Vol III, @1907, pg.. 146, "Thomas Delany age 19, witness signature on will of crewman on vessel Mary, London." The will was probated 26 July 1709.

 

Members of St. John's Parish, Joppa, Baltimore County, Maryland in 1743, at which time the birth of their son, Thomas, was recorded in the Parish records.45

36 iv. Benjamin Dulany52 was born in North Carolina 10 August 1748.Benjamin died 27 August 1826 in Butler County, Alabama, at 78 years of age. He married Rachael Murrow 10 November 1776.

37 v. Daniel Dulany was born 1750. Daniel died 1822 at 72 years of age.

6. Elizabeth2 Dulany (Thomas Delany1)53 was born 1723.54

He served in the military during war time 1755 in Connecticut. "A munster roll of Lieutenant Colonel Willam Whiting's (of Norwich) Company....."Dennis Delany enlisted 5 april 1756, discharged 17 November 1756" (Dulany-Furlong, pg. 22)

 

Dennis was listed as the head of a family on the 1790 Census in Georges Township, Fayette County, Pennsylvania.63 Census shows: three free white males of sixteen years and upward, including heads of families; two white females. As sited in Balltimore County Families 1659-1759 by Robert Barnes, published 1989 by Genealogical Publishing, Balltimore, Maryland, pg. 187: " Dulany, Dennis, age 14 in May 1744, in November 1743 was bound to Edward Sprusbanks; m: Easter Fugate on January 1749 (35:75; 131)"

 

Inherited half of the plantation known as 'Richardson's Neglect' upon the death of his father. He retained his inheritance for forty-four years and in 1785 conveyed a deed stating " I, Dennis Dulany of Washington County, Pennsylvania...."He received payment of 500 pounds for the land. 64

 

The date in which Dennis Dulany moved his family to Westmoreland, Pennsylvania is not known, but his signature appears on the petition dating 1776 or 1777 to make Pennsylvania a state. 65

 

"Dennis Dulany in Georges Township, Fayette County, Pennsylvania, undoutedly gave the name to Dulany's cave which was on the land (now known as Laurel Caverns),located on Chestnut Ridge five miles south of Mount Summit near Uniontown, Pennsylvania. Thomas Dulany, a son of Dennis, owned the land in 1815." 66

 

"Dennis Dulany lived in Westmoreland County, Pennsylvania, in that part organized into Washington County in 1781, Under date of 1 April 1785 he warranted 400 acres in Bedford County, Pennsylvania, (Pennsylvania Land Office Records, Warrant No. 83) on 25 September the land was surveyed, (Pennsylvania Land Office Records, Survey Book U, pg. 10) and Dennis conveyed a deed of sale of the tract 26 April 1786. 30 June 1785, Dennis sold his 200 acres on the Gunpowder River, Baltimore County, Maryland."67

He married Frances Stanton in Orange, Orange County, Virginia, 1739. Frances was born in Orange County, Virginia 09 November 1723. Could also be Stafford County, Virginia according to Clare Magbee's Genealogy. Frances 71 was the daughter of Thomas Slaughter Stanton and Sarah Robinson.

 

Frances died 19 January 1804 in Madison County, Virginia, at 80 years of age.72 John Dulany's Will probated 28 April 1808, Madison County, Virginia Will Book pg. 409. Also mentioned in her father's will 2 October 1741, Will Book 1 pg. 177, Orange County Virginia.

29. Daniel3 Dulany (the Younger) (Daniel2, Thomas Delany1)134 was born in Anne Arundel County, Maryland 28 June 1722. Daniel died 17 March 1797 Baltimore, Maryland, at 74 years of age. The obituary ran in the Federal Gazette and Baltimore Advertiser, Thursday, 23 March 1797, read " Departed this life on Sunday Morninglast, DANIEL Dulany, Esq., barrister at law, in the 76th year of his age. In his professional character few men have obtained a greater reputation than Mr> Dulany. After a long course of pleadings, conducted with honor and talents, and attended with success, he was appointd to the honorable office of Secretary of Maryland, a station which he filled with a character the most unblemished. In all the duties of husband, father, friend and master, he was affectionate, tender, kind and humane." (Dulany-Furlong. pg. 37-38) His body was interred Baltimore, Maryland, St. Paul's Cemetery.

 

He married Rebecca Tasker 16 September 1749. Rebecca was born 4 November 1724.135 Rebecca 136 was the daughter of Benjamin Tasker (Hon) and Ann Bladen. Rebecca died September 1822 in Brighton, England, at 97 years of age.137

 

Daniel was listed as a member of a church in St. Anne's Parish, Anne Arundel County, Maryland. "Daniel Dulany, the younger , married September 16, 1749, Rebecca Tasker, born in Annapolis, November 4, 1724, died in Brighton, Sussex, England, in September, 1822, having nearly completed her ninety-eighth year. She was the second daughter of the Hon. Benjamin Tasker, for thirty- two years a member of the Council and Acting Governor of the Province from May 3, 1752, to August 10, 1753, and Ann Bladen, his wife, the only daughter of Hon. William Bladen of Annapolis.

He was educated atEton College and Clare Hall, Cambridge University, England, where he was well grounded in English and classical literature, and was entered at the Middle Temple in January 1743. Like his father, he chose the profession of the law, but he was soon destined to out-shine him in legal attainments and become the great oracle of the law in the Province.

Returning to America, he was admitted tothe bar in 1747, and in 1751 he was practicing before the Provincial Court, where he continued to practice, with marked success, until the fall of the Proprietary Government.

Woodrow Wilson says: "Mr. Daniel Dulany's 'Considerations on thePropriety of Imposing Taxes in the British Colonies for the :IT]Purpose of Raising a Revenue by Act of Parliament' supplied the great Pitt with the chief grounds of his argument against taxing America. a Maryland lawyer had turned from leading the bar of the province to set up the true theory of the constitution of an empire with the dignity,the moderation, the power, the incommunicable grace of a great thinker and genuine man of letters"----- (Source: History of the American People. "Hon. Daniel Dulany, barrister at law, was Commissary-General, Secretary of Maryland, and one of the Proprietary Council. Although a Loyalist, the eminent barrister did not hesitate to throw all the weight of his intellect and influence against any attempt to execute the obnoxious Stamp Act. His pamphlet was of the most convincing, statesmanlike and logical character and as much applauded in England by those who opposed the Stamp Act as in the Colonies. It is said that the great Pitt, when he made his celebrated speech in the House of Commons in opposition to the proposed taxation, held a copy of Daniel Dulany's pamphlet in his hand. Prior to the Revolution the barrister stood without a rival in the Colony as a lawyer, scholar and orator, and in the first volume of the Maryland Reports his opinions are published with the decision of the Provincial Court.

Letters from the peoplethrough the vehicle of the press appear to have been quite as much the prerogative of the early Marylanders as at the present time. Over anonymous signatures in the Maryland Gazette Daniel Dulany andCharles Carroll, of Carrollton, carried on a brilliant controversy relative to an act regulating the fees of public officers. The Vestry act relative to taxes imposed by law for the support of the Established Church was another measure which enlisted Daniel Dulany's interest. The Revolution followed close on the heels of this rebellious period, and, opposing the separation of the colonies from the mother country, Daniel Dulany, when the Revolutionary War began, retired to private life, left hishome at Annapolis and took up his abode at his country seat, Hunting Ridge, on the crest of the Patapsco Hills. His estates at that time, in addition to Hunting Ridge, included over seven thousand acres of very valuable land lying in the vicinity of Frederick City, and he had another property besides, all of which was confiscated and sold in 1781 for 84,602 pounds." He then moved to Baltimore Town where he resided till his death. 138

Third, I will and bequeath to my kind and loving wife Nancy Dulany all my real estate, during her natural life and also her choice of my horse creatures so that she keeps two horses for her own use, four cows and one third of the balance of my personal estate at the time of the appraisement. Fourthly, my will is that the balance of my personal estate be sold by my executors at once and the proceeds thereofbe divided equally amongst my children; Samuel, William, Susannah, Dennis, Mary, Sarah, Jacob, James, Anne, and Barbara Dulany. Fifthly, I will and devise to my son Samuel Dulany's son Denis Dulany, twenty dollars to be paid to him when he arrives at the age of twenty-one years. Sixthly, my will isafter the death of my beloved widow my real property is to be sold together with my personal property, by my heirs and the money arising therefrom to be equally divided between them. He married Nancy Rodes in Albermarle County, Virginia, 10 September 1788.245 Nancy was born 16 June 1769. Nancy 246 was the daughter ofDavid Rodes and Mary Mills. Nancy died 23 August 1799 in Sullivan County, Tennessee, at 30 years of age.

 

He served in the military during war time 1776. He served as an orderly under General Isaac Shelby at the Battle of King's Mountian. Major William Dulaney moved from Virginia and settled near Bristol, Tennesssee at Holston valley. He was one of the first white settlers of the region maintaining afarm where built a fort that served as protection and safety when needed. It later became the firstschoolhouse in the valley. He also owned slaves that worked his fields and maintained his home. According to Robert Duggan the house was built around 1776-1789 and it still stands in Holston Valley, currently owned by Paul Ringley. 247

In 1783, he moved his family to Madison County, Kentucky, and represented that county in the Convention held in Danville, 1787. On the formation of the State he was appointed one of the justices of Madison County and later Judge of the Circuit Court. In a note written to a friend, George Washington, stated "Our celebrated fortune, Miss French, whom half the world was in pursuit of, bestowed her hand on Wednesday last, being her birthday, upon Mr. Ben Dulany, who is to take her to Maryland in a month from this time." 414 Elizabeth 415 was the daughter of Daniel French and Penelope Manley.

 

Elizabeth died in "Shuter's Hill", Alexandria, Virginia.

 

He served in the military during war time in Virginia. Answering the call of conviction and of duty, Benjamin Tasker, took up the cause of the Revolution even though the rest of his family remain loyal to the crown. He was in full sympathy with the Colonists and joined the army in Virginia. He was a personal friend of General Washington, who made him one of his aides.

 

Washington MSS. 122 and 1557 Revolutionary Records, Richmond, Virginia Benjamin Tasker Dulany went to Frederick County to live before the War of the Revolution, residing at "Prospect Hall," near Frederick Town. It is there he met Elizabeth French and married her, the daughter of Daniel French of "Claremont," FairfaxCounty, Virginia, and the ward of General Washington, who gave her away at her wedding. 416 In 1782 Mrs. Benjamin Dulaney had 102 slaves on a tobacco plantation in Virginia. 417

 

It was Benjamin who presentedGeneral Washington with the celebrated horse 'Blueskin', which he rode during the Revolutionary War. The horse was returned to Mrs. Dulany with the following note at the close of the war. "General Washington presents his best wishes to Mrs. Dulany, with the horse Blueskin, which he wishes was better worth her acceptance. Marks of antiquity have supplied the place of those beauties with which the horse abounded in his better days, nothing but the recollection of which and of having been the favorite of Mr. Dulany in the days of his courtship can reconcile her to the meagre appearance he now makes. Friday, past 2 o'clock." 418

 

"Benjamin Tasker Dulany and his son, Benjamin Jr., were members of the Masonic fraternity, Alexandria Lodge No. 22,Virginia. The former was a member in 1784 and the latter in 1896. Benjamin Tasker Dulany was present when the Alexandria Lodge, now called Alexandria-Washington Lodge, layed the cornerstone of the capital on 18 September 1793. He was also present at the banquet on Saint John;s night 24 June 1784 atWise's Tavern in Alexandria with General Washington and others." 419

He married Mary Eleanor Braden. Mary was born January 1796. Mary 615 was the daughter of Robert Braden and Elizabeth Stephens. Mary died 08 April 1829 in Loudoun County, Virginia, at 33 years of age. "Died at Waterford on April 16th, Mrs Mary Dulaney, consort of Capt. Zachariah Dulaney." (Obituary from "Genius of Liberty", Vol XIII, #22, June 6, 1829; found at T. Balch Library, Leechburg, Virginia, March 1996)

 

Her body was interred 20 April 1829 in Paeonian Springs, Loudoun County, Virginia, Catoctin Free Church Cemetery. Zachariah left Virginia in the summer of 1832 after the death of his wife, abandoning his two children. Their uncle, Noble Braden took them in and cared for and educated them.

Dulaney) went to Virginia for the purpose of bringing my sister, Elizabeth (Lizzie) out from the Confederate lines. I went to Washington first to solicit the aid of the President and Secretary Usher. I obtained some orders to the Commanding General at Harper's Ferry to assist me in getting through the lines. While in Washington I called upon President Lincoln on a day when the Cabinet was in session....On my way up to Harper's Ferry on the train, I asked the conductor if there was anyone on the trainfrom Leechburg or near there. He pointed to a nice looking gentleman who said he lived near there and I asked him if there was any way to get over to Leechburg or Waterford. He looked at me with a smile and said he knew but one way to get there. He said, "When you get to Harper's Ferry, get upon Loudoun Heights and get them to put you in one of the large cannons and shoot you over--and as soon asyou drop, Mobley [sic] will pick you up." I did not take this advice but instead saw the General in command who told me to go down to the bridge crossing the Shenandoah River to Virginia and wait for people coming in with supplies for the market and try to get word to my sister by one of them. I watched that bridge for three or four days and finally encountered a boy who lived near Uncle Noble Braden's. When he said that he knew this Uncle, I offered him $10,00 to deliver a letter to him. I wrote the letter and gave the boy his money. The next day my sister arrived at Harper's Ferry and I brought her out to Marshall."
